Bush Commutes Libby's Prison Sentence

Good. A full pardon would have been better, but this certainly helps rectify the grossly unjust sentence against Libby.

BY THE PRESIDENT OF THE UNITED STATES OF AMERICA A PROCLAMATION

WHEREAS Lewis Libby was convicted in the United States District Court for the District of Columbia in the case United States v. Libby, Crim. No. 05-394 (RBW), for which a sentence of 30 months' imprisonment, 2 years' supervised release, a fine of $250,000, and a special assessment of $400 was imposed on June 22, 2007;

NOW, THEREFORE, I, GEORGE W. BUSH, President of the United States of America, pursuant to my powers under Article II, Section 2, of the Constitution, do hereby commute the prison terms imposed by the sentence upon the said Lewis Libby to expire immediately, leaving intact and in effect the two-year term of supervised release, with all its conditions, and all other components of the sentence.

IN WITNESS THEREOF, I have hereunto set my hand this second day of July, in the year of our Lord two thousand and seven, and of the Independence of the United States of America the two hundred and thirty-first.

Libby got his dates crossed up under oath to a special prosecutor, who had, and still hasn't any intention of going after the real perpetrator, Richard Armitage.

I have an exercise for the class. Which of the two crimes, Libbys or Bergers, do you think is of more importance?

Libby his dates mixed up during the course of interrogation into a crime wherein the perpetrator is already known or:

WASHINGTON (CNN) -- Former National Security Adviser Sandy Berger was sentenced Thursday to community service and probation and fined $50,000 for illegally removing highly classified documents from the National Archives and intentionally destroying some of them.

Geez, I wonder what those docs were that he destroyed before going in front of the 9/11 commission?

I don't excuse Berger and don't know how he got off without jail time, expecially with Abu Gonzalez as Attorney General. Maybe Bush should impose a tougher sentence, what do you think neocon?

This is what Obama said about this commutation and it is spot on IMHO....

"This decision to commute the sentence of a man who compromised our national security cements the legacy of an Administration characterized by a politics of cynicism and division, one that has consistently placed itself and its ideology above the law. History will record this as a great day. Scooter Libby is an American hero who tried to expose the lies of Joe “the liar” Plame-Wilson. The tragedy is that Plame-Wilson will probably never serve a day in jail for his crimes.

My respect for President Bush has gone up for this brave and principled move. He ignores the polls and does the right thing once again.

Bush commuted the prison sentence of Libby using the same rational that the Republicans used to impeach Clinton. Bush waited until all legal efforts to spare Libby were exhausted and then when the outcome was not what CHENEY wanted, he had a lawyer write some BS and disseminate it on a Monday afternoon before a holiday. No personal press conference, but some cowardly crap.
They should all rot in hell. There has never been a weaker congress and a more power mad executive than what we have today. Where are the button men when we need them?

How many of you have a friend or family member who has received a custody sentence from a court? How many of those were commuted by the President?

That in a nutshell is why this decision will stink to most Americans. Few know or care what Libby did. What matters is that he got off and you wouldn't.

This is one more example of why Geroge W. Bush is God's gift to the Democratic party. How did so politically astute an administration go so brain dead?

My son is about to do 13-days picking up trash after being stuck in jail for four days because he crashed his car while driving on a suspended license. That is exactly what he deserves.

Think he's happy seeing Libby walk? Guess again. Guys like you and me are way too into politics to see the world the way most people do. There is huge frustration over preferential legal treatment of the rich and powerful, and this will add exponentially to that frustration. Bush has lost his touch.

Armitage was the leak to Novak, but Libby did leak the name to Judy Miller and the guy from Time, I can't remember his name. That was established in the libby trial. The leak could not be proven beyond a reasonable doubt because of the perjury and obstruction Libby made before a grand jury and the fbi. This just shows how turdly supports the rule of law only when it suits his purpose. Turdly should have pardoned Libby. Libby was just a good soldier who took the bullet for Cheney.

...the pardon controversy has reemerged in an obscure court case in which Senator Clinton's brother Tony is battling an order to repay more than $100,000 he received from a couple pardoned by President Clinton. Tony Rodham, who acknowledged approaching the president about a pardon for the couple, is the second of Hillary Clinton's brothers to receive money from people who were eventually pardoned by President Clinton. Hugh Rodham received $400,000 from two people, one of whom was pardoned and one whose sentence was commuted.

...Court Judge Marian Harrison of Nashville ordered Tony Rodham to respond by March 16 to the allegation that he failed to repay a loan of $107,000 from the couple pardoned by Clinton, according to attorneys involved in the case.

President Clinton's pardons have been a political issue for Hillary Clinton because of her ties to a number of the cases. In addition to the people who paid her brothers, those receiving pardons included commodities trader Marc Rich ... Special Counsel Patrick Fitzgerald knew who the "leaker" was almost from the very beginning, yet he pressed on investigating a "crime" for which no one was ever indicted. Many, many months and millions of dollars later, the best Fitzgerald could do was a questionable conviction of Libby for lying and covering it up.

CBS Exclusive: Sept. 7, 2006...

"I almost immediately called Secretary Powell and said, 'I'm sure that was me,'" Armitage says.
Armitage immediately met with FBI agents investigating the leak.
"I told them that I was the inadvertent leak," Armitage says. He didn't get a lawyer, however.
"First of all, I felt so terrible about what I'd done that I felt I deserved whatever was coming to me. And secondarily, I didn't need an attorney to tell me to tell the truth. I as already doing that," Armitage explains. "I was not intentionally outing anybody. As I say, I have tremendous respect for Ambassador. Wilson's African credentials. I didn't know anything about his wife and made an offhand comment. I didn't try to out anybody."
That was nearly three years ago, but the political firestorm over who leaked Valerie Plame's identity continued to burn as Special Counsel Patrick Fitzgerald began hauling White House officials and journalists before a grand jury.
Armitage says he didn't come forward because "the special counsel, once he was appointed, asked me not to discuss this and I honored his request."


CBS News, September 13, 2006...

Early in the leak inquiry, Armitage had told authorities he was Novak's source. Armitage said Special Prosecutor Patrick Fitzgerald asked him to not to say that publicly. Fitzgerald then pressed on with the investigation, questioning White House aides. Among them was Rove, who appeared five times before a grand jury before being cleared of wrongdoing this summer.

The whole investigation was basically a witch hunt which the Democrats insisted upon in hopes of convicting President Bush, Vice President Cheney, or Karl Rove of some crime. That's all we heard for three years, but in the end, the only thing the Democrats got was Libby's conviction for lying and covering up his lies.

Why did Fitzgerald ask Armitage to "keep quite" and not let the public know that he was the source and that Fitzgerald already knew that? Why? So Fitzgerald could continue on with his witch hunt, inquisition, and grillings?!!!

If Fitzgerald had terminated the "inquisition" (a.k.a. investigation) and stopped the repeated grilling of people like Libby and Rove as he should have once he knew who leaked Plame's name, it's likely that no one, including Libby, would have been found guilty of anything!

My mistake on the grand jury. Libby did commit perjury in front of a GJ, and for that he is being punished. But here is the meat of the whole case:


Fitzgerald repeatedly lied, both in court and out, about the nature of his investigation in a successful effort to convince the jury that Libby had something to hide. Worse yet he pursued a criminal investigation when he had no reason even to suspect that any crime had been committed.


On October 1, 2003, Richard Armitage told both Secretary of State Colin Powell and the FBI that he "was the inadvertent leak".

On October 16, 2005, Judith Miller published an account of her grand jury testimony.....My notes do not show that Mr. Libby identified Mr. Wilson's wife by name. Nor do they show that he described Valerie Wilson as a covert agent or "operative," - Judith Miller

uh....c-ass-per, it IS something Clinton DID do.

Including Puerto Rican TERRORISTS, in which a bombing killed a police officer. All for the sake of some votes for Hillary.

Marc Rich, oh wait, he skipped town, never facing trial, for illegal dealings with a hostile nation, and Clinton pardoned him. Denise must have done some special favors for that.

Over 100 pardons to LEGITIMATELY convicted criminals, and no one asked questions on the left.

In Scooter Libby's trial, the jurors were asked how they felt about the Iraq war. What relevance is that? Other than packing the jury with anti-Bush members. Can you honestly say that Libby received a fair trial?

Talk about cover ups and a complete travesty and utter miscarriage of justice...

Scooter Libby was given 30 months in jail and a $250,000 fine for lying (possibly forgetting) and covering up an investigation into a crime for which no one was ever charged, and for which the "leaker" was already known early in the investigation.

Sandy Berger, President Clinton's former National Security Adviser, on the other hand, deliberately steals and destroys some of our nation's most highly classified documents and information in an effort to hide and cover up something which was obviously of great and grave importance to the 9/11 Commission and the American people.

Sandy Berger steals and destroys our nation's secrets, lies to investigators, destroys and thus withholds information from the 9/11 Commission investigating the worst attack on American soil in our nation's history... and for that Berger gets 100 hours of community service, 2-year probation, a $50,000 fine, and pays $6,905 for the administrative costs of his two-year probation!

Where is the national and Democrat outrage, and cries for a full investigation (inquisition!) from the DEMOCRAT Congress for what Sandy Berger may have destroyed, hidden, and covered up that's far more important to the American people and history than Libby's "crime"!

DEMOCRATS control Congress. DEMOCRATS are conducting investigations, inquiries, and hearings on everything imaginable. Why aren't the DEMOCRATS in Congress investigating Sandy Berger and trying to find out just what he REALLY destroyed and WHO he is REALLY trying to protect?

Let's find out what President Clinton did that's warrants the theft and destruction of highly classified documents from America's National Archives and from the scrutiny of historians!

Oh, that's right! Libby is a Republican and Berger is a DEMOCRAT, and it does not serve the DEMOCRATS' AGENDA to investigate one of THEIR OWN!!!

As someone pointed out to me, If Libby were pardoned, he would not be able to take the Fifth if further questioned.

So, 30 months (2 and 1/2 years) is too much for someone with a wife and kids to serve? I'll remember that the next time I hear about "25 to life" for a young father.

The real implication here for Bush haters is that he might mass-pardon his whole administration at the end of his term, thus giving everyone carte-blanche from now until then. THAT's what's got them frothing.

Oh, and for a government that came into power with the promise of avoiding even the appearance of favoritism and corruption, this has been a watershed signing for Bush. The Republican's new dawn has reached its sunset.

Another made up issue by the libs! Libby was not convicted of comprimising our national security nor was he on trial for that.

Bitter partisanship of recent years? Oh, please, more inflaming and divisive rhetoric.

All his comments, put simply, are complete lies!

Libby did not receive a fair trial, when jurors are interviewed with completely irrelevant questions. The jurors were asked how they felt about the Iraq war!! The sole purpose of which was to stack the jury against Bush and his administration.

Now if Libby was convicted of a terrorist bombing and was pardoned, then you would have something to bitch about. Oh wait, Clinton did that and all that was heard from the left was the sound of crickets chirping!

Everytime you open your mouth, you reveal what a complete buffoon you really are. Clinton was not charged with lying to CONGRESS, but was brought before CONGRESS at impeachment proceedings for lying to a grand jury under oath and obstruction of justice in a civil case. He was never charged with lying before Congress.

Stop being a slave to lib talking points. It only decreases your credibility. And if you want to save what infinitessimal (that means very very very small - almost non-existant) credibility you have left, you would quietly go away.

The prosecutor, the district court judge, and a federal appeals court, all largely Republican. How could it have been more fair? The questions about Bush and the Iraq War was probably to keep liberals off to avoid a jury that would simply convict based on spite. Ever consider that?

Once again, the armchair legal scholars of Blogs for Bush think they know more than a Bush appointed prosecutor, a Bush appointed judge, a grand jury, a jury of his peers, and the judge presiding over the grand jury. The wealth that is your legal expertise must be astounding!

I have seen the "there was no crime committed" defense (see all of the people who have to be wrong/stupid/party to some liberal conspiracy), the "Clinton was much, much worse, I promise" defense (since when is it good to compare yourself and your heroes to the dregs of society?), the "Sandy Berger is the DEVIL!" defense (how did you tie that to 9/11?), the "Armitage was the leak!" excuse, but none of them have any real legal basis. However, I'm sure you know what your talking about... I mean, what do those legal scholars and jurists have on your massive legal knowledge base...? Yeesh...

I'm perfectly content with this commutation. It shows that Bush likes his nepotism, but doesn't have the balls to see it through all the way (perhaps showing that he has doubts about his political capital)... This case, more than any others, clearly demonstrates the BDS syndrome that is so rampant on the left. Gar Wood, Rana, Kblack, etc., are so filled with laughable rage it's almost fun to watch.

This is such a low level matter that it would barely even hit the radar in most administrations, in fact, it wouldn't have even come up in most administrations because of THE FACT that leaking Plames identity does not constitute a crime.

Sandy Berger was not tried in a court. Berger reached a plea deal to avoid a trial. Compared to Libby, Berger received a slap on the hand from the legal system and a pat on the back from Clinton!

Berger steals and destroys our nations secrets and possibly incriminating and highly significant classified information, lies to investigators, and deliberately attempts to destroy and withhold information critical to the 9/11 investigation (and possibly succeeds) and for that he gets 100 hours of community service, 2-year probation, a $50,000 fine, and pays $6,905 for the administrative costs of his two-year probation!

Libby is convicted of lying and covering up a crime that did not occur and he is sentenced to 30 months in prison, plus two years probation, plus a $250,000 fine!

Democrats feign outrage over the "severity" of Libby's "crime", but show little or no concern over Berger's actions and cover-up which was the real crime directed at our nation's security!

You couldn't care less about Sandy Berger who lied, lied to the FBI, tried to cover up his lies and actions, stole national secrets, stole and destroyed highly classified information, and interfered with the 9/11 Commission investigation into the worst attack on American soil in our history?

That fact raises even more questions about Sandy Berger recent actions to VOLUNTARILY give up his law license and right to practice law in order to avoid more questions about the crime, the documents, his role, his actions, what he REALLY destroyed, and WHO and WHAT he was protecting and covering up!

The Fifth Amendment does not prevent Congress from further investigating the crime, especially in view of the fact that we now know Sandy Berger had access to more documents, including original documents, than the "copies" which were the subject of the original investigation and his plea deal.

Knowing that he is safe from "double jeopardy" and can't be convicted for the same crime "again", Sandy Berger should now be willing to tell Congress and the American people the WHOLE story and the REAL story!

Perhaps too, with enough investigating, testimony, and grilling of the type Fitzgerald conducted in his inquisition of Libby, other facts and crimes may come to light which aren't protected by the Fifth Amendment!

The point I was trying to make is that Clinton was impeached for the exact same crime that Libby was convicted of by a President who as govenor was pardon adverse. Look at Karla Faye Tucker for example whom he scoffed at her pleas for mercy after finding Jesus and being born again. What ever that crap means.
Matt and Mark try to claim that Democrats are corrupt. I'd rather be corrupt than to have no principals. Equal justice under the law no longer has any meaning and the mushroom cloud that is at the center of this is our entire concept of rule of laws...not men...being nuked by those who claim to be beholden to that tradition. Why would Berger want to steal copies of highly classified documents, including FIVE copies of the SAME document?

Because those copies may (and possibly did) contain ORIGINAL NOTES from Berger, senior members of the Clinton Administration, and possibly President Clinton himself.

Why do Republicans have such contempt for the people? Libby wasn't convicted by Patrick Fitzgerald, he was convicted by a jury of his peers.

And he would be convicted 100 times over. There isn't a jury in the world that wouldn't convict him. The evidence is overwhelming, and the dates mixed up excuse is so laughable it's almost not worth responding to. But then again I'm not going to convince anybody, because those who believe that are just being good little authoritarians.

And by the way. Libby's sentence was completely consistent with federal sentencing guidelines. So when does bush start pardoning all people convicted of perjury and obstruction?

It's funny how when Clinton lies to a Grand Jury it's an impeachable offense, but when Scooter Libby does it it's a horrible injustice. But Republicans haven't been principled for years now have they.

What the judge did shows the basic unfairness of the treatment of Libby - he was railroaded by an out-of-control prosecutor who used a biased jury to gain a conviction on a non-existent crime.

You seem to be the only one that gets it; Scooter was denied his freedom while the appeal goes on, something that almost anyone else would have been granted. Bush commuted the sentence; effectively allowing Scooter free while his appeal is processed.

If the appeal is successful, Bush (and Libby) will have been vindicated. If the appeal fails then Bush will pardon Libby which is his Constitutional right to do so.
