Why Filibuster Alito?

While there are probably a lot of different ways of expressing why the left wants a filibuster of Alito, I think that the reason for it is only one thing, and John Nichols, blogging over at The Nation, gives us the most concise explanation I've found so far on the left:

Samuel Alito has established himself, through his record as an appellate court judge and his testimony to the Senate Judiciary Committee, as the consumate judicial activist. He seeks a place on the Supreme Court in order to advance his vision of an imperial presidency that does not obey the laws of the land or answer to the Congress. Alito is, by his own admission, intellectually and politically at odds with the intents of the founders, and with the Constitutional system of checks and balances that they established. He has gone so far as to advise past presidents on strategies for expanding executive power and, as a judge, he has erred on the side of even the most reckless abuses of executive authority.

What we have here is the belief that Alito is seeking a Supreme Court seat with a purpose - in this case, the purpose of advancing President Bush's out-of-control Executive Branch and its mad rush to dictatorship. Its all part of the great plan, don't you see? And so Alito must be stopped in order to preserve our Constitution - in order, that is, to preserve America as a free nation.

Keep in mind that the left is serious - this isn't just rhetoric designed to pump up the base: this is what is really believed. We on the right might have thought that Cindy Sheehan was an abberation but we now know that she's entirely mainstream on the left and doesn't, indeed, even represent the most extreme leftwing views. What this tells us is that the left might very well push the Democrats to a filibuster. We'll find out for sure on Monday, but I figure its a 50/50 chance that they will round up the 41 votes needed to prevent cloture.

And, of course, we wish them the best of luck with their effort. The left really is the gift that keeps on giving.

I love how everybody who tries to offer some view that isn't in lockstep to exactly how this administration wants you to think is from the "left" -- man, you'll be cutting out your left eye and spitting on the Declaration of Independence just as long as Fox News gets you riled up and then tells you to. Then they'll convince you your right eye is left and tell you to cut that one out too.

In order to understand this filibuster, start start by accepting the premise that there will be no negative consequences for trying, and much to be gained by the attempt. Those in favor of Alito will vote for him and those against will not. IF the wobbly senate fails to vote closure, it is a BIG WIN for the ideologues. If the majority stands firm (A GREAT BIG IF, GIVEN THEIR HISTORY!!!), the ideologues claim they stand on principle and are loved by the base.
Recent history gives a big clue to the outcome: agreements mean nothing. The minority may agree to an 'up or down' vote and then renege, catching the majority off guard. When opponents are fairly evenly matched, the swing of just a few votes changes the outcome. The Democrats realize this and stand firm, giving them an inordinate amount of power as a minority. They appeal to Republican 'moderates' to break with their party, and have been successful in the past.
Al Queada knows that when one is weak they offer truce and compromise until they are ready to attack. There are some members of congress who take the same approach.

I'm reminded of the 1972 movie, "The Candidate", in which Robert Redford plays Bill McKay, a somewhat idealistic and naive young Senate candidate from California. In a conversation with an old Robert Byrd type pol, (I'm paraphrasing because it's been 34 years since I saw the movie.) the old pol says to McKay, "this isn't about the TRUTH, son, this is about POWER".

Washington is and always has been, first and foremost, about POWER. Those that have it want to keep it, and those who had it but don't anymore, want to get it back. Unfortunately the truth and what's right often get lost in the shuffle.

It's going to be interesting to see how this plays out on Monday and Tuesday. As I said in a thread yesterday, I really don't see how the Dems come out of this a winner, no matter what they do, but, in the end, it all comes down to whether or not 51 Senators have the stones to do what's right.

I wish I could be confident that "Fisk will bring in the cots..." - but the recent history of this senate shakes my confidence. 59 senators may follow their Constitutional obligations, but when the minority stands as a unified block, it takes only a few defectors to prevent a the will of the people.
If Fisk is unable to hold the Majority, including McCain and others who play to the media, the MSM will bombard the otherwise apathetic public with propaganda about an abuse of power, and weak Republicans will crumble once again.
When I mentioned no consequences, perhaps I should have emphasized for the Republican wimps who abandon their constituents for some face time with the media. I fear those Senators who now indicate they will vote for Alito, may succumb to pressure (and political promises) and change their mind at the moment they cast a vote.

So far they're doing exactly what I predicted a few weeks ago. Party line out of the Comitee, threaten the Filabuster, and now we're at the big day. Originally I said they'd back down but as of today I'm a bit iffy but I'll stay by that original prediction. It makes things fun. ;)

So, I'll see them talk and talk about filabustering but at the end just going for a vote. That's my guess.

President Bush has been successful every time the opposition underestimated him. The MSM may be trying to turn the tables on him now. The early reports that the nomination of Justice Alito would get an up or down vote was designed to make the opposition look reasonable to the general public. Now a maverick or two raises the possibility of a filibuster, and the MSM sings his praises. When it comes to the moment of voting, the lock step Dem's and a few 'moderate' republicans can shock the world with their stand on principle.
I know the voters on my state will return Hillery and Chuck to the Senate, no matter how they vote. They know they can play to their base without any political risk at the local level.

Hey I'm tired of fighting this stupidity. I say we Blue Staters get behind the neocons and help roll back all federal legislation. The Red states could make abortion illegal, roll back labor laws (so all the extra children could work in factories), ban teaching of evolution....what the heck get rid of ALL public education, drop all publicly funded health care, head start ect.......


Then us Blue states could use the people in the Red States for cheap labor instead of having to go all the way to China we could just take advantage of their massive unemployment. We could set up factories there and dump all our toxic waste and trash in the Red states with their lax environmental laws and all that. With the extra money the Blue states would have since they would no longer be subsidizing the red states we could put it into more world class universities, fund a single payer health care system, stem cell research, we'd have even more pristine national parks....our roads would be nice, our skies clean, with good access to health education and family planning our populations would stabilize,,, and heck instead of adopting kids all the way from China we could just go to the Blue states cause they'll have lots of extra babies needing homes.

Yeah Go Alito Go!!!! I'm a federalist now!

Oh, and also take a High and Mighty attitude of "I'm right, you're wrong, deal with it, because there is no way in Hell that I'll ever be wrong." Unfortunately, this is an attitude that many Conservatives all too often take. You know, the babified and pathetic throwing around of the word "moonbat" and also such nice things as saying that anyone who even dares to question George W. There was another time in history when people who questioned the motives of the govenment were called names and ridiculed, and the phrase "America, like it or leave it, Commie Pinko Fags" was probably thrown around. Except the country was actually Germany, the year was 1939 or so, and the current person people were questioning was none other than Adolf Hitler. It's really not that complicated. The Democrats have been hoisted by their own cuteness. The gang of 14 is in the way now. From the beginning I said the gang of 14 was a Republican win -- It was simply Byrd's way of stopping the rule change, you use it, you lose it.

I think when a party goes into insanity, as today's Democrats have done, the rest of the country should just walk on by whistling.

Civil liberties are disappearing daily, the Constitution is being shredded, all this talk about the country-world ending, it is causing my head to hurt. It used to be funny, now it's just stupid.

Hmmm, Mel, you make my eaxact point. You are ARROGANT and basically do not care about anybody else unless share your own views. To question things that the government does and the state of the country IS AS AMERICAN AS YOU GET!!! If not, we never would have seperated from England. The Conservatives are constantly insulting Liberals and saying that they are "Communists" and the like. Maybe for some Liberals this is true, but for the vast majority of people who have voted Democrat, or questioned the war, etc, etc, they are just average Joes who would like to make a difference. You CANNOT, I repeat, CANNOT change something for the better unless you question or doubt the current situation. That is all people are trying to do, to makes things better for EVERYONE. You do realize that many of the soldiers fighting in Iraq and other places are not all Conservatives. They are AMERICANS, and some may have Liberal views. Yet they are DYING to protect this country.
