January 24, 2006
Judiciary Committee Vote

Well, I've been watching, it's currently a 10-6 partyline line. Senator Biden just finished telling us that we still live in a racist society.

Kyl, "Why is this committee divided over Judge Alito?" He says it cannot be over his qualifications.

10:39 a.m. ET: Kohl just voted no. Says abortion is a right in the Constitution.

10:46 a.m. ET: DeWine is up now,but his vote was already counted.

10:53 a.m. ET: Feinstein is up now, she's probably going to tell us what she feels her duty as the only woman on the judiciary committee is.. "Personal views and legal philosophies do play a role." Says she believes Alito will join Scalia and Thomas as strict constructionists of the Constitution. There you have it... The Democrats oppose strict interpretation of the Constitution.

10:58 a.m. ET: She repeats the "long standing precedents" argument. She must believe that slavery and segregation were wrongly overturned...

11:01 a.m. ET: Says being pro-choice abortion, she can't vote for Alito.

11:10 a.m. ET: Sessions is up now... Thank God! Feinstein was ridiculous. FYI, comments and trackbacks may be turned off at various times this morning and the rest of today in response to server issues.

11:13 a.m. ET: Feingold is up... He voted for Roberts, so we'll soon find out his vote on Alito... I expect he'll vote with fellow Wisconsin Senator Kohl.

11:14 a.m. ET: I was right. Vote is 10-7 now.

11:30 a.m. ET: Graham speaks... Says the quality of the process, not the noiminees has changed... Worries that the nominated process will become just about abortion.

11:38 a.m. ET: Schumer is up. He obviously was voting no. As expected, the final vote is 10-8. It's a sad day for the nomination process.

11:51 a.m. ET: Cornyn is now up. But, I'm out for now... I am confident that I am not alone in my belief that the Democrats behavior during the hearings, and ultimately their vote, was shameful. They've turned the confirmation process into a partisan war... I am incredibly disappointed that Alito didn't get the support from the entire committee. The Democrats were unable to deny Alito's qualfications, but they don't like his views and how they believe he will vote. They don't want someone with no agenda, but rather they want someone with a liberal agenda for the courts. It's a sad day for the confirmation process, indeed.

11:58 a.m. ET: Durbin plays the Miers card.

THE FINAL VOTE:

Yes

  1. Brownback
  2. Coburn
  3. Cornyn
  4. DeWine
  5. Graham
  6. Grassley
  7. Hatch
  8. Kyl
  9. Sessions
  10. Specter

No

  1. Biden
  2. Durbin
  3. Feingold
  4. Feinstein
  5. Kennedy
  6. Kohl
  7. Leahy
  8. Schumer

This morning I tried to listen to Leahy and Teddy 'hic' Kennedy speak their points, but I couldn't..

I changed the channel to re-runs of "Walker Texas Ranger", and the "A-Team".. Both programs were much more truthful and real....

My G-d, these Dems aren't qualified to pick their Asses, let alone a Supreme Court Justice. How obvious is it that they are bought and paid for by the Abortion on Demand Industry, and Soros. What a joke. This is embarrassing.
And Biden is going to go monitor PA Elections. Taking the Jimmah Carter route to the WH.
Why oh why did I watch this?

Posted by: BurbankErnie [TypeKey Profile Page] at January 24, 2006 11:42 AM

The Democrats have perverted the confirmation process.

Posted by: Matt M. at January 24, 2006 11:44 AM

No big surprise. Party line vote. Typical. And the sitting Dems gave more blog fodder as usual.

Posted by: Carl at January 24, 2006 11:57 AM

Durbin is a joke like the rest of these looney Democrats.

watching this is torture.

There you have it... The Democrats oppose strict interpretation of the Constitution.

After all, they are the party of, "It depends on what your definiton of 'is' is.

Well, I'm not on board with Matt's statement. The Senate Dems can vote up or down for any reason or (good news for them) for no reason whatever. Like impeachment it is a vote for which they are subordinate only to their constituents. If they don't like Alito's haircut, vote him down. Of course they do not say this and that is, obviously, the point of contention. But for our own tactical position, Alito or any of dozens of other potentials moves the last redoubt of Leftwing power a scooch to the right. A scooch matters mightily as this alteration is cumulative. The Lefties of course know this quite well. Roe has poisoned them but it has been a slow process. The symptoms are now acute. Noonan said it well that after this bold attack failed; a formulaic attack that has been wildly successful for decades failed it can never succeed again. "It's over." meaning the Dems ability to use their stranglehold on the public forum to costlessly slander their opponents. Us. Their power rested on that ability far more than even I had conceived. It's way over. HA!

Durbin isn't worth the used toilet paper he was wrapped in at birth.

Democrats in Congress are Anti-US and political terrorists.

Posted by: Bret Helm at January 24, 2006 12:20 PM

at least the 14, correctly, will stop any donk filibuster...pre-emptively.

and we know how much the left hates pre-emption, well...'cept for pre-empting a birth!

While there is nothing that can be done about the posturing of the Dems in the Alito matter, there is one area where we are dropping the ball and letting them run with it.

We need to be very aggressive in jumping on them every single time a reference is made to the effect of reversing Roe v Wade. They are sometimes implying, sometimes actually stating, that a reversal of Roe will "outlaw" abortions. They are implying, and sometimes stating, that a reversal of Roe is a statement about whether or not abortion should be legal, or allowed. And we let them get away with it. Those lies are now embedded in the consciousness of most Americans, unexamined, unchallenged.

I think it would go a long way to both defusing the Alito opposition and pointing out the willingness/eagerness of the Left to lie to achieve their goals, if we would simply stop every speaker in his/her tracks when such an allegation is made, and make the correction then and there.

Imagine any of them dealing with a direct question: "Senator, are you claiming that a reversal of Roe v Wade would outlaw abortions?" Or "Senator, are you alleging that a vote on whether not there is a right to abortion present in the constitution as it is written is the same as an opinion on whether or not abortion should be legal?" Back them into a corner.

Make them lie on camera. Make them look like either liars or stupid--or, in the cases of many of them, both. Given a choice, I think they would prefer to be seen as liars than as ignorant of the law---after all, they are in a party which not accepts liars but defends them. But it will not play well.

Make them address the true issues. Make the statement that no meaningful debate can take place if the definitions of the debate are false. Make them debate the constitutionality issue, and don't let them turn it into a choice issue. Emphasize that Roe actually took the "choice" away from the people and put it into the hands of five appointed justices, and that a reversal of Roe, totally on constitutional grounds, RE-ESTABLISHES true choice by letting the people decide.

I say these clowns are continuing to sink their own ship, shoot their own foot! Canadian voters are waking up, and additional American voters will change sides to the Republicans.

We simply need to pound on the hypocrisy and absolute bias of the MSM. Thank you Al Gore for the internet, and for being a disciple of the John Kerry school of flip-flopping! The internet and blogs came at the perfect time to save America and the free world.

Posted by: SEW at January 24, 2006 12:34 PM

Well, as usual, Almiranta nails it. Well done.

/Agreed

Roe Vs Wade is not the end all or be all of what should make someone be on the Court. As much as I'd like to know how Alito would rule on my "pet topics" it doesn't mean I should vote against him.

Posted by: Gozer [TypeKey Profile Page] at January 24, 2006 10:34 PM

We have seen how the Senate Dems voted against Alito for purely political reasons. With such a highly qualified nominee, it cannot be seen as anyother way. The majority of Americans support Alito's nomination and I am sure that he will be confirmed.

How one issue—abortion—can mezmerize the Democratic party as much as it does is beyond me.
