Court upholds NYC subway searches

More common sense Federal Judges please, and the faster the better. This is why this country needs a Republican President. Judges matter.

New York Civil Liberties Union attorneys were reading the decision Friday and had no immediate comment.

Yeah, I bet they are. The ACLU has become the enemy of those of us who just rather not be blown up on a Subway or train. We are funny that way.

Just for kicks, I'm going to point out that one of the judges on the 3-judge panel was appointed by President Clinton. Another was appointed by Carter. The third was in fact nominated by a Republican, President Nixon.

While you may be right that judges matter, it appears that in this case their party affiliation did not. Try again next time.

Speaking as a person who lives in NYC and takes the subway everyday I'm glad that we've made our subway safe from a couple of drug addicts and an person with a "conduct" problem. Hey and it only cost us our 4th Amendment rights. (smile) :-)

Problem being going forwad, is that the ACLU ( who is fighting this ) has toooooooooo many Ruth Bader Ginsburg ( ex- ACLU leader) types in their midst, that would/could be appointed by a leftist president.

On March 11, 2004 in Madrid Spain, Muslim terrorists detonated 10 bombs concealed in backpacks aboard 4 commuter trains at the height of rush hour. 192 people were killed. 2,050 people were injured.

Putting your bag through an x-ray scan is tremendously different than you being arbitrarily stopped and having your bag searched through by a police officer. The government's wish for a search has its limits. Try living here in NYC then tell me they are the same. You have no idea.

I haven’t been searched (n the subway) myself but you know who I’ve seen being search? African Americans, Hispanics and Muslims. Those pictures you see of whites opening their bags for cops are just publicity shots. More often than not those cops are just sitting 3 at a fold out desk just filling space. When they do anything it's targeted at New York's emigrant population. Unless you live here Freedom, or for that matter anyone else, you have no credibility on this issue in my opinion. It's a useless program and ultimately a danger to our liberties.

Aren't you being just a little dramatic here? If you want a false sense of security and safety then stay in your little town. New York isn't a place for the timid like you Paul.

Well let's examine that decission for a second. It was a political C Y A move by those judges. They know as do most New Yorkers that the program is totally unconstitutional and ineffective but do they want to be labeled as the ones who removed it when another terrorist attack eventually comes here. NO!!! What they did was insulate themselves from blame pure and simple.
This desission will eventually be overturned by a higher court on 4th Amendment grounds most likely.
Now on to the effectiveness of the program. No one here has commented on that. Not one arrest. NADA A ONE. What few arrests have occurred ,mostly drug related and small time at that, are likely to be overturned on Constitutional grounds. As will, although I'm 99.99999% sure there will never be an arrest on terrorism related charges, those charges will not stand muster either. When that happens then you'll come back here and complain again about how those liberal New York judges are letting the terrorist kill us.

Oh but I forgot, we New Yorkers have to give up our rights to keep up the appearence that New York is a safe place for people like Paul who want to come here and shop in the big fancy Old Navy store. Then he can go back home with his oversized T-shirt that has an American flag blazing across his chest and say to all his friends" Yea I know it's just ur'ssssss but I got mine in NEUW YOARK." ohhhhhhhhhh ahhhhhhhh

How many bombings have there been on the Subway since 9/11? I have been up to New York many a time, spent 30 days in a row, working at a packaging plant on Bath street. That is one crappy city. folks are rude, dirty, smell downright terrible, but boy can they hang tennis shoes from just about anywhere.

Pizza was awesome, so was the Greek food. Buildings there got rats as big as cats, hell the security guards had names for most of them, nice pets. Here in fly-over country we kind of like cats and dogs and maybe even a horse.

In the meantime, if you get stopped just smile when they inspect your bags. My guess is that the SCOTUS will allow the searches so will 75% of the rest of us.

But, that is just a guess

You know what just galls me? The ACLU is on our side you maroons. They help protect and battle for the civil rights of all. Get it? ALL. Not just the civil rights you think are allowable. But the civil rights guaranteed us by the constitution. Yes, sometimes murderers get represented. Justice will, and should, prevail. Tell me oh wise ones, is there any point when you will say enough erosion? What will it take? You must see the logic in protecting even the toughest to understand civil rights. Then again, most of the posters here are fat middle aged white men who grew up not always with a spoon in the mouth, but advantaged enough to take our civil rights for granted. Wise up. Buffoons.

How many terrorists have been captured with this program? How many plots thwarted by bag searches?

You have to either say I don't know or zero because that's exactly what this program has produced.

I know this program isn't working because the number of people riding the subway every day is about 4.5 million. The odds of a cop randomly finding a bomb in someone’s bag with those numbers are astronomical at best.

Your championing a program that, by it's own admittion, is the tactical equivalent of standing before a crowd of thousands, taking a rock and throwing it in the air, then counting on it hitting the guilty party. The only trouble with your approach is, doing that, you tend to hit mostly the non-guilty or as in this case only the non-guilty.

Sounds like more of the George Bush wishingful thinking approach to problems.
