Civil Liberties in Holland

We get this from Peaktalk via NRO's The Corner:

Just to show how far Dutch tolerance goes: Ayaan Hirsi Ali’s neighbors have sued the Dutch state in order to get her to be removed from the apartment complex in which she is living under police protection. The request was initially rejected, but following an appeal a higher court has now ordered Hirsi Ali to leave her house within four months, I translate:

The court considers in its ruling that the neighbors have been put into a situation that has contributed to them feeling less safe in their own house. That feeling is extended to the communal living spaces of the apartment complex, but also to their own apartments. The court argues that this is a severe violation of one’s private life (as per Article 8 of the European Treaty for Human Rights).

A few things. Firstly, it should be noted that Hirsi Ali is now booted out of her own house by virtue of the European Treaty for Human Rights which does indeed supersede Dutch law. Many cases are adjudicated by referring to this treaty, but given the subject matter here I would say: Euroskeptics, go knock yourselves out.

Secondly, and this is the one that really bothers me, is that somehow Hirsi Ali’s neighbors self-interest runs so deep that they are prepared to use the court system to throw someone whose life is in danger out of her own house. It goes like this: we’re tolerant, we support free speech and a critical attitude, but if it comes too close to our front porch, sorry, we are no longer interested. On the contrary, self-interest is the deciding motivator. True, Hirsi Ali’s flatmates do have a reasonable point in arguing that the Dutch State has an obligation to ensure that their security measures benefit the entire complex. If the State has dropped the ball in that respect, they should be compelled by the courts to correct this, but to put the burden on Hirsi Ali is a very disturbing precedent. Yet, the plaintiffs are quite happy with the ruling:

This is an example of European cowardice. Now, its not like I desperately want someone hunted by terrorists to be living next door to me, but if I had one then no power on Earth would ever make me try to force that person out. In fear and trepidation, I'd stand with my neighbor.

Someone please explain to me just how Europe is a model for America...

Mark, before hand i thought perhaps you like to use stereotypes alot, but then I thought I may possibly be wrong, but this clearly shows you love to use sterotypes. Please explain how 1 example like this can be used to describe an entire group of people. If you really believe this to be the case then I would like to call you a Nazi, here is my proof.
There is a nazi party in america
since we can use stereotypes with a single example we can now conclude all americans are nazis.

kiwi,

Nice try - but Holland is the place of euthanised babies and elderly people...they really aren't very pleasant over there, and this is just ANOTHER illustration of how there are no civil liberties in Europe...just a dying population of welfare junkies who, above all things, want the quiet life...bunch of cowards, that is what they are.

Posted by: Mark Noonan [TypeKey Profile Page] at April 30, 2006 03:15 AM

Wow!
Thing sure have changed since the days of Ann Frank, haven't they?

Posted by: dbogdan [TypeKey Profile Page] at April 30, 2006 04:30 AM

Mark, you would call the people of europe cowards? were the recent protests in france the act of a coward? was the french people standing tall and saying "nou" to the EU consitution the act of cowards? was Italy voting for a left leaning government even though they know bush will try somethign to undermine their authority (as he has done in the past with the likes of chavez) the act of cowards? look at both sides before claiming europe is full of cowards.

Posted by: kiwi at April 30, 2006 04:39 AM

Kiwi,

Frankly its disturbing that you dismiss this ruling as insignificant while in fact an important legal precedent has been set which will adversely affect the lives and freedoms of euros for years to come.

If you can't understand the difference between small fanatical fringe element and the precedent set by state and EU judicial rulings, then there is no point in debating the issue with you.

Posted by: phnxbmed at April 30, 2006 06:55 AM

There's a reason it's called,"Dutch courage".

Posted by: patch [TypeKey Profile Page] at April 30, 2006 08:19 AM

Interesting allegory, Kiwi. Completely off the mark, as well as a typical argument by invective from a lefty, which did not actually address the content of the post.

Mark, it looks like the French are spreading their meaning of life. Whine, Cheese, and Surrender. Which is exactly why the Left loves Europe. Heck, the Left would love to allow millions of potentially violent Muslims into the USA, preferably prior to Bush leaving office. That way, they could blame W for the resulting violence for the next 20 years.

Posted by: William Teach [TypeKey Profile Page] at April 30, 2006 08:56 AM

William, I think I hit the mark perfectly, my goal was to disprove his point, which I am pretty sure I did unless you are willing to admit my conclusion was correct? (eg all americans are nazi's)

Posted by: kiwi at April 30, 2006 09:14 AM

kiwi -- Article 8 of the European Treaty for Human Rights is no "stereotype". It's the law of the land over there.

Posted by: JPL [TypeKey Profile Page] at April 30, 2006 10:00 AM

"euthanised babies and elderly people". Yup, that's completely objective and non-emotive.
So, you wouldn't dare request that your neighbour move because you're scared, but you're happy to go to /WAR/ against several countries, who have only weakly proven weak links with 'international terrorism' (said with appropriate condescension); not only that but you're happy with the implied casualities of people that are completely innocent.
Moreover, you're doing this in the name of a war on terror that started by an incident which wasn't that significant. More people die from each of road accidents, disease, and murder every year.
But then you're not familiar with the fact the when people disagree with you they might resort to violence, like the IRA and ETA in Europe. Then again you're not really familiar with the fact that quite a lot of the world disagrees with you.

When London was bombed, everyone had a cup of tea and the trains that were able to were runing again in the afternoon. The worst thing that happened from it was that some police got a bit excited and shot an innocent person. And mostly we're a bit pissed off about that, they should be professional about these things.

Er, well right. Sorry, if that got a bit away from the issue at hand.

Mark, as usual you assert your ABSOLUTE ARROGANCE
here, yet you pretend to be "humble."

The main problem with America is that act like we HAVE to be the best and the greatest at everything, and will stop at nothing to beat everyone else. It is idiocy and ARROGANCE.

America was not like this until recent years (from around the 1950's.) We all stood together with the rest of the world before then, and did not ridicule other countries. We fought for REAL good, the good of ALL mankind, and not just the good that would make our country richer and more powerful.

If you ask me, when America became a superpower, it went to our heads, and people like you exemplify that arrogance (which is actually insecurity in disguise - most arrogance is) which says that America is the most badass country on the planet and all other countries suck. That is the lesson you are touting, Mark, and it is pitiful. Show a little "Christian" respect for the rest of the world and other cultures. Do you want your kids to be like this?

Maybe people in Europe just do not want to be as cocky and egotistical as Americans, maybe they understand that arrogance is actually FEAR of what is different. Think on these things, Mark....

You know who stereotypes whole groups of people by ethnicity or citizenship? Nazis. That's what you are.

kiwi:

Mark says:

Holland is the place of euthanised babies and elderly people.

This is the rawest example of the Catholic's obsessive concern for life before birth and at death. In between they are a lot less concerned.

Posted by: Ash [TypeKey Profile Page] at April 30, 2006 06:05 PM

*Sighs*

Again it comes down to being Christians? What is up with folks and bagging on religion? What the heck does it have to do about a court case in Holland?

Anyway, the case is odd to me. Is the state going to look after this lady after kicking her out? Maybe put her up in a safe house or something? Only then could I see kicking her out as "okay," not right, but "okay." At firt blush it sounds like they're just forcing this lady out on her own while she's in dnager, doesn't sound very neighborly to me.

kiwi, your so-called "argument" is being ignored because it is so silly.

Europe is becoming sad and pathetic. You completely missed the point that WE think is significant:

That Dutch law is superseded by the European Treaty for Human Rights.

Let me explain that to you. A country, once a sovereign nation under its own rule, has ceded its sovereignty to a socialist concept. It is now letting one of its own citizens, a woman who had previously counted on the protection of her own country, to be removed from her home and deprived of protection as a citizen, due to a ruling of people who are not even Dutch.

The conclusion reached by many of this is, this is an excellent example of what happens when socialism runs rampant and when countries turn over their own rule to other nations. Supporting, by the way, the U.S. rejection of the idea of joining in some cockamamie "World Court".

We will make our own rules, for our own citizens, and we will defend those citizens, and we will not allow other countries to impose their rule on us. Unlike the Dutch. Unlike much of Europe.

And the illiterate dithering about the "courage" of some French protest---only the Left finds courage in walking around yelling and waving pre-printed placards--- or in Italy electing a leftist government. ?????????? Wow---you are awfully easily impressed. (Bet you thought John Kerry was courageous for throwing someone else's medals over the White House fence, too---but only after making sure the cameras were running and he had his speech memorized.)

Guess it's just a difference of opinion, about what is courage and what is cowardice. Hint: Cowardice was forming the Vichy govenrnment: Courage was going in and saving their butts. The coward's way would have had them speaking German---our way gave them their country back. Guess we needed some kiwis over here, PROTESTING. I can see the signs now---No Blood For Brie.

Almiranta

Americans, renowned for their patriotic fever, misjudge other countries constantly.

Don't be so fast to bury Europe with your false impressions. Take a good hard look at what is happening in your own yard. It's not a pretty sight.

Posted by: Canadian Observer at April 30, 2006 08:35 PM

This is why Europe is becoming EURABIA...so sad.
WAKE THE HELL UP!

Posted by: Macker [TypeKey Profile Page] at April 30, 2006 10:06 PM

Sorry that the current state of European affairs isn't to your liking.

You probably look to the German and Italian governments of the 1930s and 40s for the Republican ideal.

Posted by: DAV [TypeKey Profile Page] at April 30, 2006 11:04 PM

DAV,

No, we'd just prefer an Europe which at least had the will to live...

Ash,

We're concerned about life from start to finish...you just don't like what we have to say for those who are between birth and death...

Posted by: Mark Noonan [TypeKey Profile Page] at May 1, 2006 12:48 AM

"you just don't like what we have to say for those who are between birth and death..."

Well actually Mark, I don't much care for what you have to say about birth and death either.

Posted by: Ash [TypeKey Profile Page] at May 1, 2006 08:59 PM

No, Mark, you just want Europe and the rest of the world roll over to American interests AND you want them to take on the best traits of what it means to be American, which include such things as NOT rolling over to the interests of others.

Isn't it illegal to screw your own dog[ma]?

By the way, "they" call it "Dutch courage" because "they" == the British, who way back when HATED the Dutch, a prejudice that has historically only been matched by people like you who slur "Liberal" people.

It's ok to hate, mark. It's just not ok to put it into law. And it's not ok with me and most candid people to hide behind a twisted morality instead of just owning up to your own hatred.

"Sin bravely". That was said by a German. You might know who.
