In all of the various criticisms of Harriet Miers, none of them - in my view - rose to a substantial level. The complaints were all worries, a fear that Ms. Miers might not be conservative enough. I thought to be in opposition based upon a mere worry was insufficient - there has to be something concrete. Well, we might have something concrete now:
As president of the State Bar of Texas, Harriet Miers wrote that "our legal community must reflect our population as a whole," and under her leadership the organization embraced racial and gender set-asides and set numerical targets to achieve that goal.
Now, the news story does go on to note that Ms. Miers didn't initiate the program and other people quoted about it insist that it wasn't a quota system - just an aspiration for Texas law firms to shoot for. Still, this is a bad thing - that Ms. Miers would say a certain set of people must mirror a set of demographic statistics indicates she does not understand the baleful aspects of affirmative action. Texas law firms, like all private enterprises, must reflect the best talent available for the job at a given moment...not someone's notion of what is a "fair" number of skin colors or genders. It doesn't matter in the slightest if a firm is 100% black or 100% white...or 100% purple with yellow polka dots; the only thing that matters is that the people in the firm were each hired on their individual merits. Affirmative action - and the racial set-asides it always entails - is un-American and in direct contravention of the letter and spirit of the Constitution of the United States of America.
I'm not prepared to oppose Miers over this issue - it was, after all, from more than a decade ago. But I'm going to have to get a clear indication from Miers during the hearings that she is adamantly opposed to government mandated affirmative action programs, or I will have to oppose her.

Finally you guys are coming around. Get this gal off the list. She is not conservative and will most likely not do well at the hearings. Please W, pull the plug like many of us Conservatives have been saying for weeks now!!!!

At which point it is likely too late to go into opposition. Once she reaches Committee, she'll likely be confirmed just to keep from embarrassing the President.
